Tier 1 of the Points Based System is aimed at ‘high value migrants’ such as investors and entrepreneurs who have funds available to set up or invest in a business in the UK, graduates with an endorsed business plan and those deemed to have exceptional talent within their field of expertise. 

There are two new categories introduced into Tier 1:
1. Start-Up visa;
2. Innovator visa.

The Start-Up visa route will be open to those starting a business for the first time in the UK, while the Innovator visa route will be for more experienced business people who have funds to invest in their business.

What is a Tier 1 Start Up visa?

The Start Up is for individuals wanting to set up business in the UK. It replaces the Tier 1 (Graduate Entrepreneur) visa, which is now closed to new applications. The Start up visa is open to graduates and non-graduates who can demonstrate a business idea with potential.

How much do I need to invest for a Tier 1 Start Up visa?

There is no requirement to show funds for investment for a Start Up visa.

What are the requirements for a Tier 1 Start Up Visa?

You will need to start with an idea for a business. This idea then needs to be presented for approval to an approved ‘endorsing body. The Home Office provides a list of endorsing bodies covering various sectors and fields that are permitted to endorse a business idea for the purposes of this visa application.

You will need to evidence through a business plan and supporting documents that your business idea is viable, innovative and scalable.

If you secure endorsement, you have three months to make your visa application to the Home Office.

What is a UK Innovator Visa?

The UK Innovator visa is a category for those that wish to set up and run a business in the UK, and are able to invest funding into the business.

How much do I need to invest for the UK Innovator Visa?

You will need to demonstrate of a minimum investment of £50,000.

What are the requirements for a UK Innovator Visa?

You must be able to show that you have at least £50,000 to invest in the business.

Also, crucially, you will need to have your business idea endorsed by an ‘endorsing body’. This is a relatively new feature of the UK immigration rules, and was introduced so that endorsing bodies and business experts, rather than the Home Office assessing applicant’s business ideas. The Home Office provides a list of endorsing bodies covering various sectors and fields that are permitted to endorse a business idea for the purposes of this visa application.

You must also show that you are able to financially support yourself in the UK without recourse to public funds.

How long will my Tier 1 Visa Application take?

The time can vary, and depends on a number of factors.

There are some factors within your control, such as ensuring that you comply with all of the stipulated requirements and provide all the necessary documents. In cases where there are missing documents, a decision may take longer. This is why it is important that you receive correct advice at the appropriate time for your case.

On average, decisions are made in around 6-12 weeks. You do have the option of paying an additional premium, to receive a decision within 2 weeks.
